WORK CONTRACT & TERMS AND CONDITIONS

These terms apply to all painting and decorating services provided by Finish Painting & Decorating.

1. Parties

This Work Contract ("Agreement") is entered into between Finish Painting & Decorating ABN [ABN NUMBER] ("Contractor") and the client whose details are specified in the accompanying quote or job sheet ("Client").

2. Scope of Work

The Contractor agrees to perform the painting and decorating services as described in the written quote provided to the Client. Any variations to the agreed scope of work must be requested in writing and may result in additional charges. The Contractor will use materials of a professional standard unless otherwise agreed in writing.

3. Quotation & Pricing

All prices are as stated in the written quote provided prior to commencement of work. Quotes are valid for 30 days from the date of issue. The Contractor reserves the right to adjust pricing if the scope of work changes, or if unforeseen conditions are discovered during the course of the work (e.g. significant surface damage, rot, or mould). The Client will be notified of any additional costs before work proceeds.

4. Payment Terms

A deposit of 30% of the total quoted amount is required prior to commencement of work. The remaining balance is due upon completion of the work and before the Contractor vacates the premises. Payment may be made by bank transfer, cash, or other agreed method. Invoices not paid within 7 days of the due date may incur a late payment fee of 2% per month on the outstanding balance.

5. Client Responsibilities

The Client agrees to: • Provide clear and safe access to all areas requiring work at agreed times. • Remove or protect personal belongings, furniture, and valuables prior to commencement. • Ensure pets and children are kept away from work areas during the project. • Notify the Contractor of any known hazards (e.g. asbestos, lead paint, structural issues) prior to commencement. • Ensure adequate power and water supply is available on site.

6. Preparation & Surface Conditions

The Contractor will carry out standard surface preparation as included in the quote (filling minor cracks, light sanding, cleaning). Significant repairs, treatment of mould, or other additional preparation work may be quoted separately. The Contractor cannot be held responsible for paint failure caused by pre-existing surface conditions not disclosed or visible at the time of quoting.

7. Workmanship Warranty

The Contractor provides a 12-month workmanship warranty on all painting and decorating services. This warranty covers defects in workmanship such as peeling, flaking, or significant colour variation caused by the Contractor's application. The warranty does not cover: • Normal wear and tear • Damage caused by moisture, water ingress, or structural movement • Damage caused by the Client or third parties • Surfaces not prepared or primed as recommended

8. Timeframes

The Contractor will provide an estimated start and completion date. Timeframes are estimates only and may be affected by weather conditions, unforeseen site issues, or delays outside the Contractor's control. The Contractor will communicate any significant delays to the Client as soon as practicable.

9. Cancellation

If the Client cancels the job after a deposit has been paid and work has not commenced, the deposit is non-refundable to cover scheduling and material costs. If the Client cancels after work has commenced, the Client is liable for the cost of work completed to date plus any materials purchased. The Contractor reserves the right to cancel the agreement if site conditions are deemed unsafe or if payment obligations are not met.

10. Insurance

The Contractor holds current public liability insurance. A copy of the certificate of currency is available upon request. The Client is responsible for ensuring their own property insurance is current and adequate.

11. Dispute Resolution

In the event of a dispute, both parties agree to first attempt to resolve the matter through good-faith negotiation. If a resolution cannot be reached within 14 days, either party may refer the matter to a relevant dispute resolution body in New South Wales. This Agreement is governed by the laws of New South Wales, Australia.

12. Acceptance

By accepting the Contractor's written quote or allowing work to commence, the Client acknowledges that they have read, understood, and agree to the terms and conditions set out in this Work Contract.
